Please read these Terms of Service (“Terms”) carefully before using the products, services, or communications offered by Putnam Oil (“we,” “us,” or “our”). By accessing our services, making a purchase, creating an account, or opting into our text messaging program, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services or enroll in our SMS communications program.

1. SMS / Text Messaging Program
a. Program Description & Messaging Use Cases
Putnam Oil operates an SMS/MMS text messaging program to communicate important information to customers who have opted in. Messages sent through this program may include:
• Delivery confirmations and scheduling notifications
• Heating oil and fuel delivery reminders and estimated arrival windows
• Service alerts, outage notices, or emergency communications
• Billing reminders and payment confirmations
• Seasonal promotions, pricing updates, and special offers
• Account updates and customer service follow-ups

This is an Application-to-Person (A2P) messaging program. Messages may be sent using automated technology, including but not limited to automated dialing systems or pre-written messages. Consent to receive automated messages is not required as a condition of purchasing goods or services from Putnam Oil.

b. How to Opt In
You may enroll in our SMS program by:
• Checking the SMS consent box on our online or paper account enrollment or service request form
• Verbally consenting during a customer service call (confirmed via a follow-up text)

By opting in, you confirm that you are the account holder or authorized user of the mobile number provided, and that you consent to receive text messages from Putnam Oil at that number.

c. How to Opt Out
To stop receiving text messages at any time, reply STOP to any message from Putnam Oil. You will receive one final confirmation and will be removed from the program immediately.

After opting out, no further SMS messages will be sent to your number unless you re-enroll. Opting out of SMS does not affect your service account or any other communications (e.g., billing statements sent by mail or email).

e. Message & Data Rates
Message and data rates may apply. You may receive up to 4 messages per month. Frequency varies. You are responsible for any charges imposed by your wireless carrier for sending or receiving text messages.

Putnam Oil is not responsible for any charges you incur from your mobile carrier as a result of participating in our SMS program. Check with your wireless provider if you have questions about your messaging plan.

f. Carrier Liability Disclaimer
Carriers (AT&T, Verizon, T-Mobile, etc.) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your carrier and is not guaranteed.

Putnam Oil is not responsible for messages that are delayed, blocked, or undelivered due to wireless carrier network conditions, technical failures, or actions outside our control. If you are not receiving expected messages, please contact us directly.

g. Age Restriction
You must be 18 years of age or older to enroll in the Putnam Oil SMS program. By opting in, you confirm that you meet this age requirement.

If we learn that a person under 18 has enrolled in our SMS program without verifiable parental or guardian consent, we will remove that number from our messaging list immediately.

2. Services
Putnam Oil provides heating oil delivery, fuel services, and related products to residential and commercial customers. The availability of services, pricing, and delivery schedules are subject to change. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

Customers are responsible for maintaining accurate account information, including service address and contact details. Putnam Oil is not liable for missed deliveries or service disruptions resulting from inaccurate information provided by the customer.

3. Customer Accounts & Billing
Customers are responsible for maintaining the confidentiality of their account information. You agree to notify us promptly of any unauthorized use of your account. Payments are due in accordance with the billing terms specified in your service agreement. Putnam Oil reserves the right to assess late fees for overdue balances as permitted by applicable law.

4. Privacy Policy
Your use of our services and participation in our SMS program is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and protect your personal information, including your mobile number. Key Privacy Policy highlights relevant to SMS:
• We do not sell or share your mobile number with third parties for marketing purposes
• Your SMS opt-in data is used solely to send the messages you have requested
• You may request deletion of your personal information at any time

5. Disclaimers & Limitation of Liability
Our services and communications are provided “as is” and “as available.” Putnam Oil makes no warranties, express or implied, regarding the reliability, accuracy, or availability of our SMS program or website. To the fullest extent permitted by law, Putnam Oil shall not be liable for any indirect, incidental, or consequential damages arising out of your use of our services or SMS program.

6. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on our website with a revised effective date. Continued use of our services or SMS program after such changes constitutes your acceptance of the updated Terms.

7. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Putnam County, New York.
